STEAMBOAT SPRINGS, COLORADO-August 22, 2022- The District Court issued its Order today regarding the referendum petition filed on Ordinance No. 2869 (Short-Term Rental Tax). The District Court denied the Petitioners’ request for a preliminary injunction requiring the City Clerk to approve its petition.
The referendum petition was rejected by the City Clerk on July 28, 2022, for its legal insufficiencies under the City Charter and related election ordinances.
In its Order, the Court found that “denying this motion actually serves the public interest by permitting a comprehensive vote on the substantive issues of the Short-Term Rental Tax, rather than vote on a confusing procedural issue where the vote might never take place”.
